As you go through the home buying process, it is important to understand the relationships between the various parties involved. The listing agreement signed when a home Seller decides to offer a home for sale, creates a legal relationship known as “agency” between the Seller and a real estate Agent or Broker. Legally, it means the Listing Agent owes allegiance to the Seller. The Listing Agent is obliged to protect the interests of the Seller during the process.
Historically, Buyers haven’t had the same level of representation as sellers.
We work as the “Buyer’s” Agent and formalize our responsibility to potential Home Buyers by using:
A. The “REAL ESTATE AGENCY DISCLOSURE AND ELECTION” form. This form is an in-depth explanation of the responsibilities of real estate agents to Buyers or Sellers. It allows the parties in either role to agree to allow the agent to act as a “dual agent” by representing the interests of both parties at the same time.
B. A “BUYER-BROKER EXCLUSIVE EMPLOYMENT AGREEMENT”. Just as the Seller has a formal agreement with the Listing Agent, this agreement establishes a formal relationship between ourselves and the Buyers we chose to work for.
While the documents define the formalities of the relationship, forms alone cannot guarantee the level of service we strive to accomplish. Other companies or agents may use these forms because their use is strongly encouraged by the Arizona Department of Real Estate. We use them because, when all parties understand the guidelines, an atmosphere of mutual trust is created.
